This Web Site is owned by Tanoa Hotels. Please read these Terms and Conditions carefully before proceeding as they govern your use of this Web Site and any goods or services obtained through it. By using this Web Site you will be taken to have agreed to these Terms and Conditions. If you do not agree to these Terms and Conditions, you must not use this Web Site. Certain capitalised terms that are used in these Terms and Conditions are defined in the “Definitions” section below.

Tanoa Hotels reserves the right to change information published on this Web Site at any time.

Definitions

In this Web Site unless the context otherwise requires: "Applicable Law" in relation to any person, action or thing means the following in relation to that person, action or thing:

any law, rule or regulation of any country (or political sub-division of a country);
any obligation under any licence in any country (or political sub-division of a country); and
any lawful and binding determination, decision or direction of a regulator in any country (or political sub-division of a country).

“Intellectual Property" includes the design of, and all content appearing on this Web Site, trade marks (including logos), domain names, copyright, rights in computer software, databases and lists, confidential information, know-how and trade secrets and manuals, whether registered or unregistered. "Products" means the products you may obtain through this Website from time to time. "Services" means the services you may obtain through this Website from time to time. "Submit" means to submit, post, upload or transmit in any manner (whether electronically or otherwise). "Tanoa Hotels" means Tanoa Hotels Group and its Related Bodies Corporate.

Interpretation

In these Terms and Conditions, unless the context otherwise requires:

words importing the singular include the plural and vice versa;
other parts of speech and grammatical forms of a word or phrase defined in this agreement have a corresponding meaning; and
headings and underlining are for convenience only and do not affect the interpretation of this agreement.

Personal and Non commercial use

This Web Site is for your personal, non-commercial use. You may not modify, adapt, copy, distribute, transmit, broadcast, display, perform, reproduce, publish, license, create derivative works from, incorporate in other works (whether electronic or not), transfer, or sell any information, software, products or service found on or obtained from this Web Site (collectively, "Tanoa Hotels Information"); provided that you may download, reproduce, and retransmit Tanoa Hotels Information solely for your personal, non-commercial use. With the exception of the foregoing limited authorization, no licence or right in any copyright or other intellectual or industrial property right of Tanoa Hotels or of any other party is granted or conferred to you.

Credit card information

The rates on the Tanoa Hotels Web Site are only available by booking through this Web Site. All payments for Products or Services obtained through this Web Site are to be made in advance by a valid credit card. Tanoa Hotels may contact you directly to confirm your credit card details. The credit card will be used via a secure site to debit the total cost of the Products or Services purchased from our Web Site. Once your credit card has been processed, we will email your Confirmation Email to you, which MUST BE retained for check-in purposes. All rates for accommodation in New Zealand and in Fiji are in New Zealand dollars and will have stated as to whether they are inclusive or exclusive of GST (being tax levied in accordance with the Goods and Services Tax Act 1985 and includes tax levied in substitution for such tax). You will also pay all other applicable taxes, import duties, levies or tariffs which may be payable (if any).You must be at least 18yrs of age to make a booking on the Tanoa Hotels Web Site.

All clients will be required to provide a credit card at hotel check-in to cover incidental charges. You may also be required to present a photo ID on arrival at the hotel.

Cancellations

A cancellation charge will apply for all bookings after the confirmation email has been issued. The cancellation fee will vary depending on the check in date. Cancellation fees will be charged in New Zealand dollars for all accommodation in New Zealand and in Fiji. When a booking is cancelled within 2 days of the check in date or less, a cancellation fee equal to the first nights accommodation will apply. The same will apply if the client does not show up on the check in date at any of our hotels. When a booking is cancelled anytime up to 2 days prior to the check in date a cancellation fee will be charged. All cancellations must be made in writing by emailing us on reservations@tanoahotels.com.fj or by faxing us on 649 3790182.

We require your Booking Reference No, and your Name & Surname used in the booking. A cancellation must be confirmed back to you by one of our consultants. If you have not received a confirmation of the cancellation within 24hrs of submission, it means that we have not received your request and you must resubmit it.

Amendments

An amendment charge may apply for all bookings after the confirmation has been issued. If you would like to extend the length of your stay or the number of rooms taken then no extra charges will apply. If you would like to decrease the length of your stay or the number of rooms at any of our hotels then a fee will apply if outside of 2 days prior to check-in. If within 2 days to check-in the first nights accommodation may be charged. All amendments must be made in writing by emailing us on reservations@tanoahotels.com.fj or by faxing us on 649 3790182.We require your Booking Reference No, and your Name & Surname used in the booking. An amendment must be confirmed back to you by one of our consultants. If you have not received a confirmation of the amendment within 24hrs of submission, it means that we have not received it and you must resubmit it.

Child Policy

Children up to 12 years old sharing a room with an adult, using existing bedding and not requiring a rollaway bed, will be accommodated free of charge. In any circumstances where a rollaway bed is required, the extra person rate will apply. Cots are available at the same cost as an extra person charge. You will need to check with reception upon check in as to the availability of any rollaway beds or cots.

Exclusions and liability

To the fullest extent permitted by law:

all warranties, representations and guarantees (whether express, implied or statutory) are excluded, including without limit, suitability, fitness for purpose, accuracy or completeness of this Web Site or the content on, or accessed through, it, or any Products or Services obtained from the Web Site; Tanoa Hotels will not be liable for any damage, loss or expenses, or indirect losses or consequential damages of any kind, suffered or incurred by you in connection with your access to or use of this Web Site, or the content on, or accessed through, this Web Site; and
Tanoa Hotels will not be liable for any damage, loss or expenses, or indirect losses or consequential damages of any kind, suffered or incurred by you in connection with any Products or Services obtained from this Web Site.

If the New Zealand Consumer Guarantees Act 1993 applies, you may have rights or remedies which are not excluded or limited by the above. If you are using this Web Site or its content for business purposes, the above exclusions and limits will apply and the New Zealand Consumer Guarantees Act 1993 will not apply. The exclusions and limits set out in these Terms and Conditions will also operate for the benefit of Tanoa Hotels’ partners, relevant suppliers, licensors and agents of Tanoa Hotels which Tanoa Hotels use to provide the Web Site. The information provided on this Web Site is for general guidance only. Users of the information contained on this Web Site must make their own assessment of the suitability and appropriateness of the Products, Services and information for their particular use.

You must take your own precautions to ensure that the process which you employ for accessing this Web Site does not expose you to the risk of viruses, malicious computer code or other forms of interference which may damage your own computer system. For the removal of doubt, we do not accept responsibility for any interference or damage to your computer system which arises in connection with your use of this Web Site or any linked website. Tanoa Hotels does not review or monitor any Web Sites linked to our Site and is not responsible for the content or accuracy of any such linked Web Sites. Tanoa Hotels is not responsible for the information, products, or services obtained on such other sites and will not be liable for any loss or damage arising from your access to or use of such sites. Any links to other sites are provided merely for the convenience of the users of our Web Site and the inclusion of these links does not imply an endorsement of the linked sites or the content therein. In addition, you agree not to link your Web Sites or any other third party Web Site to our Web Site without the express prior written consent of Tanoa Hotels. Tanoa Hotels reserves the right to prohibit links to this Web Site and you agree to remove or cease any link upon request from Tanoa Hotels. This Web Site has been prepared in accordance with the laws of New Zealand. These Terms and Conditions will be governed by the laws of New Zealand, and you irrevocably submit to the exclusive jurisdiction of the courts of New Zealand.
